Welcome to Mursai. By using our platform, you agree to the following terms. Please read them carefully.
Mursai is a software platform that connects to your Acuity Scheduling account to provide gift certificate management tools. Mursai is not a payment processor, healthcare provider, or scheduling system. We extend the functionality of your existing Acuity account.
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You may not use Mursai for any unlawful purpose or in violation of any applicable regulations.
By connecting your Acuity account, you authorize Mursai to access your scheduling data as described during the onboarding process. This includes your gift certificate products and catalogs, services, and calendars. You can revoke this access at any time by disconnecting from your dashboard.
Mursai subscriptions are billed monthly. You can upgrade, downgrade, or cancel at any time. Downgrades take effect at the end of your current billing period. Cancellations stop future charges but your account remains accessible until the end of the paid period. No refunds are provided for partial months.
Gift certificate purchases made through your Mursai gift page are processed via Stripe and deposited directly into your connected Stripe account. Mursai does not hold or process these funds. Your subscription fee covers the platform; there are no per-transaction fees.
The Mursai platform, including its software, algorithms, data analysis methods, report templates, user interface designs, documentation, and all related intellectual property, is owned exclusively by Mursai and is protected by applicable copyright, trade secret, and intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your own business operations during your subscription period. This license does not transfer any ownership rights.
You agree not to:
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data models, or underlying architecture of the Mursai platform.
Copy, reproduce, or create derivative works based on the Mursai platform, its features, user interface, report formats, analysis methodologies, or any other proprietary element.
Use access to the platform for the purpose of building, designing, or informing a competing product or service, whether directly or through a third party.
Access the platform for purposes of competitive analysis, benchmarking, or intelligence gathering for the benefit of any third party, including but not limited to scheduling platforms, software companies, or competitors.
Share, sublicense, or provide access to your account or the platform to any third party.
Use automated tools, bots, or scrapers to extract data, content, or design elements from the platform.
The features, functionality, analysis methods, report formats, and business logic of the Mursai platform constitute confidential and proprietary information. You agree to maintain the confidentiality of this information and not to disclose it to third parties, except as necessary for your own business use of the platform. This obligation survives the termination of your subscription.
Your business data belongs to you. Mursai stores a copy of your Acuity data to provide its services. When you cancel your subscription, your data will be permanently deleted from our systems within 30 days of the subscription end date. You may request immediate deletion at any time by contacting us. If you resubscribe within the 30-day period, your existing data and settings will be restored. We do not sell, share, or provide your data to third parties.
Mursai is provided "as is" without warranty of any kind, express or implied. We make no guarantees about uptime, accuracy of generated insights, or the availability of third-party services such as Acuity Scheduling or Stripe. Mursai is not liable for any business decisions made based on data or insights provided by the platform. Our total liability to you for any claims arising from or related to your use of the platform is limited to the amount you paid for the service in the preceding 12 months.
You agree to indemnify and hold harmless Mursai, its owners, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you are violating these terms, including the restrictions on use. In the event of termination for cause, no refund will be provided for the remaining subscription period. Upon termination, your license to use the platform ends immediately, but your obligations under the Confidentiality and Restrictions on Use sections survive.
We may update these terms from time to time. Significant changes will be communicated via email. Continued use of Mursai after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of California. Any disputes arising from these terms or your use of the platform will be resolved in the courts of Alameda County, California.
